We at Pineapple Bath (hereinafter referred as “myBillWallet”, “we”, “us” or “our”) are committed to protecting personal data and respecting privacy of the users of the Platform and/or Services described herein (each a “User” or the “Users”). Each User is hereinafter referred as “you”, “yours” and their respective connotations).

This Privacy Policy (“Privacy Policy”) sets out how we collect and process personal information of Users collected from or through (A) the website https://mybillwallet.com/ (“Website”) and/or the ‘myBillWallet’ platform (together with the Website, referred to as the "Platform"), and/or (B) use of the Platform, products and services offered by us (our “Services”), or when Users otherwise seek to do business or make contact with us. 

This Privacy Policy applies to the usage of the Platform and/or Services, and does not extend to any information collected and/or by the websites or applications of any third-parties.

Our Users’ privacy is extremely important to us. We recognize the privacy concerns of the Users and hence as a commitment to provide safe and secure experience on our Platform, we have formulated this Privacy Policy to help Users make an informed decision.

Legal Basis

This Privacy Policy is meant to help the Users understand what information we collect, why we collect it, what information we disclose and how the Users can update, manage, export, and delete their information. This Privacy Policy and the Terms shall be governed by and construed in accordance with the laws of India which are not in conflict with each other. Any disputes arising out of or in connection with this Privacy Policy shall be subject to the exclusive jurisdiction of the competent courts of Mumbai, Maharashtra, India.

Consent

By accessing our Platform and continuing to use our Services, the Users will be deemed to have read, understood and agreed to the terms as provided in this Privacy Policy. By granting their assent to this Privacy Policy, the Users provide consent to such use, collection and disclosure of personal information as prescribed in this Privacy Policy, including the transfer of personal information to third-party service providers as may be required for the purpose of providing and improving the Services.

We reserve the right to update or change our Privacy Policy at any time and the Users should check this Privacy Policy periodically. We advise the Users to check the Privacy Policy available on the Platform from time to time, provided however that any material changes to the Privacy Policy will be informed to the Users, at the contact details provided to us by the Users when they sign up for the Platform. Continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute the Users’ acknowledgment of the modifications and their consent to abide and be bound by the modified Privacy Policy. Users have the right to opt out of the Platform and/or the Services at any moment. In addition, the Users, by sending an email to [email protected], can inquire whether myBillWallet is in possession of their personal data, and they may also require myBillWallet to delete and destroy all such information, upon request.

Information We Collect and How We Use It

All information directly collected by myBillWallet is with the Users’ consent. myBillWallet is however free to use, collect, and disclose information of the Users which is in the public domain. 

Information collected from Users of the Platform shall include but not be limited to the following:

• Name, email address, phone number, date of birth and designation of the Users;
• Name and phone number of your Chartered Accountant, if required in case of CA Permissions;
• Business address of the User for certain features;
• Information on the device such as the make, model, operating system, IP address, location, and other information required for us to provide the Services;
• Information about a User’s visit such as URL information, material or information viewed or searched by the User; page response times, download errors, length of visits to certain pages, page interaction information, methods used to browse away from the page, metadata such as location, date etc., and details of email address or phone number used to contact customer service;
• Pictures and other information from the device’s camera and photo library with prior permission;
• Financial Information (including limited information regarding or derived from the payment mode, orders, invoices, and other information generated from or through the Platform and/or Services);
• Website analytics and behavioural metrics;
• Cookies and web beacon data; 
• Data from third parties such as advertising networks, analytics providers, search information providers etc. who have explicit consent to lawfully share that data; and
• Metrics on system or Platform feature use, including but not limited to the date of sign up to the Platform, number of logins, and last login to the Platform.

We may also require additional information about a User in compliance of or as required under applicable laws.

We also collect certain information either when the Users provide it while using the Platform or Services and / or automatically as the Users navigate through the Platform (which may include usage details, location, IP address, device ID and type, browser type and language, the operating system used by device, access times, and information collected through web beacons and other tracking technologies and which is covered by this Privacy Policy). We DO NOT sell this data to any third parties. 

Third parties may collect certain information by way of cookies, through our Platform. Such information may be collected, inter alia, for the following purposes: (a) advertising; (b) marketing; and (c) data analytics. To know more, please refer to the section on ‘Do we use Cookies?’

Users can, at their sole discretion and consent, upload their identification, financial, and other personal and non-personal documents, including but not limited to, Aadhar Card, PAN card, bills, coupons, Credit Cards, etc., on the Platform. The User is solely responsible for all the self-uploaded documents and retains complete autonomy to share the uploaded documents with individuals or organizations, exercising their own discretion and free will. The User hereby acknowledged that myBillWallet serves solely as a facilitator for document sharing, with the responsibility for sharing documents with requesters or other entities resting solely with the User, and myBillWallet shall not be liable for any unauthorized disclosure or sharing of such documents under any circumstances whatsoever.

How it is used: 

• To create and maintain User accounts, including personalization to improve the user experience;
• To process information such as credit card payments and provide support services related to payment, billing and invoicing;
• To engage certain trusted third parties to perform functions and provide services to us, including cloud-hosting services, off-site backups, email service providers, and customer support providers. We will only share personal information with third parties to the extent necessary to perform these functions, in accordance with the purposes set out in this Privacy Policy and applicable laws;
• To improve and enable Users to use the Platform and avail our Services, and ensure efficient customer care experience, increasing efficiency of existing features, and develop new features;    
• To improve support, marketing and promotional efforts, to analyse Platform usage, improve the Platform’s content, layout and Service offerings.
• To dispatch transaction-related communications such as welcome letters and billing reminders;
• To notify the necessary information related to the Platform and Services and User accounts on the Platform from time to time;    
• To maintain records and provide Users with an efficient, safe and customized experience while using the Platform;
• To take up or investigate any complaints/claims/disputes and to respond to User queries or feedbacks;
• To use or disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to (a) conform to applicable law or comply with legal process served on us or the Platform; (b) protect and defend our rights or property, the Platform or our Users, and (c) act under emergency circumstances to protect the personal safety of us, our affiliates or the Users of the Platform or the public. This includes exchanging information with other companies and organizations for fraud protection.
• We may send Users newsletters and e-mails to market other products and services we provide
• We may use personal information, including sensitive information of the Users to create non-identifiable “aggregate data” 
• To analyse overall trends to help us improve the Platform and Services, including displaying detailed analytics to Users;
• Verify Users’ identity and prevent fraud or other unauthorized or illegal activity;
• To comply with applicable laws, rules, and regulations; 
• And in any other way consistent with this Privacy Policy and to support the above activities.

Do we use Cookies?

Retention of Personal Information

We may retain Users’ personal information as long as a User continues to use the Platform, have an account with us, or for as long as is necessary to fulfil the purposes outlined in the policy. 

We may alsoretain personal information for an additional period as is permitted or required under applicable laws, for legal, tax, or regulatory reasons, or for legitimate and lawful business purposes.

If your account has been inactive for a reasonable period of time, we will delete the account and all of its content. You will receive a notice prior to us deleting your content to allow you to activate your account again or retrieve any data that you would like to retrieve.

Please note that we may hold anonymized data, that at one point originated from you, but as the data is truly anonymized it no longer constitutes personal data, and we can keep it for as long as it is relevant to our business purposes.  

PLEASE NOTE THAT WE DO NOT STORE CERTAIN INFORMATION ON OUR SERVERS, INCLUDING PASSWORDS, BANK DETAILS AND OTHER SENSITIVE AND/OR FINANCIAL DETAILS. THE SAME SHALL ONLY BE STORED ON THE USER’S DEVICE AND MAY NOT BE RECOVERED IN CASE THE DEVICE IS CHANGED, LOST OR BROKEN.

Disclosure of the Information Collected

We do not share/ disclose any personal information any individual or organization (public or private), however:

• We may share personal information with service providers, business partners, data analytics providers and affiliates.
• If we are involved in major business transactions like merger, acquisition, financing due diligence, reorganization, bankruptcy, sale or purchase of assets, or transition of service to another provider, personal information may be transferred as a part of such a transaction, as per applicable law and/or contract.
• We do not store personal data without the specific consent of Users, except as set out in this Privacy Policy. 

Additionally, 

• We reserve the right to use or disclose personal information in response to any statutory or legal requirements in order to protect our rights, the rights of our other Users, data processors and any other person or property. 
• We will use or disclose personal information if we believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person or property, violations of the Terms, or as otherwise required by law when responding to subpoenas, court orders and other legal processes. 

How do we protect personal information?

The security of personal information is important, and we have implemented reasonably sufficient means to protect the same, including access controls and industry- standard secure server layers encryption. We have implemented best industry practices and security policies, rules and technical measures to protect the data, including personal information, that is under our control from unauthorised access, improper use or disclosure, unauthorised modification and unlawful destruction or accidental loss. However, for any data loss or theft due to unauthorized access to the Users’ electronic devices through which the Users avail the Services, we shall not be held liable for any loss whatsoever incurred by the Users or any third-party. 

Do note that while we make best possible efforts to securely store the User Information and data provided by a User, we do not guarantee that there will be no unintended disclosures of the User information and data provided by a User on account of a data breach, unauthorized access, security failure etc. We cannot guarantee, give no warranties, and shall not be liable for breach of the security of User information through the myBillWallet Platform due to malicious attacks, errors, commission or omissions not wilfully initiated by us and any transmission is at the risk of the User.

When payment information is being transmitted on or through the Platform, it will be protected by encryption technology or other security measures as may be provided by the third-party payment services providers, including payment gateways, in accordance with their respective terms of use. You agree, acknowledge and consent to such sharing of your information with third party service providers to process payments and manage your payment-related information. myBillWallet does not guarantee that the transmissions of your payment-related information or other information will always be secure.

Do we transfer personal information internationally?

All or any information processed by us shall be processed, and stored in India. We undertake to safeguard all personal information of our users in accordance with the applicable laws.

Third Party Disclaimer

The Platform may contain links to other websites. Please note that when Users click on one of these links, they are entering another website over which we have no control and for which we will bear no responsibility. Often these websites require the User to enter their personal information. We encourage and recommend the Users to read the privacy policies of all such websites as their policies may differ from our Privacy Policy. Users agree that we shall not be liable for any breach of privacy of personal information or loss incurred by their use of such websites or services, under any circumstances whatsoever. The inclusions or exclusions are not suggestive of any endorsement by myBillWallet of the website or contents of the website. Users may visit any third-party website linked to the Platform at their risk. 

Users’ Rights

As a User, myBillWallet grants you complete control of the information submitted by you. The rights pertaining thereto are enumerated below:

• The right to access the information we have on the User. You have a right to request that we provide you with a copy of your personal information that we hold, and you have the right to be informed of: (a) a summary of your personal information which is being processed us; (b) the processing activities undertaken by us with respect to your personal information; (c) the data controller’s identity (i.e., information about persons who control the manner in which your personal information is processed); and (d) the entities or categories of entities to whom your personal information may be transferred.

• The right of rectification. You have a right to rectify in the profile section of the Platform or request that we rectify inaccurate personal information, complete the incomplete personal information or update the personal information. We may seek to verify the accuracy of the personal information before rectifying it. 

• The right to erasure. You can also request that we erase your personal information in limited circumstances where:

1. it is no longer needed for the purposes for which it was collected; or
2. You have withdrawn your consent (where the data processing was based on consent); or
3. following a successful right to object (see right to object); or
4. it has been processed unlawfully; or
5. to comply with any legal obligations.

We are not required to comply with your request to erase personal information if the processing of your personal information is necessary (a) for compliance with a legal obligation; (b) or for the establishment, exercise or defence of legal claims.

• The right to withdraw consent. Users have the right to withdraw their consent at any time, when consent is given pertaining to personal information.

• The right to unsubscribe. You may always opt-out of receiving future e-mail messages and newsletters from myBillWallet. However, you cannot opt out of Service/Platform related announcements, e.g., if the Service is temporarily suspended or if the Platform is under maintenance.

• The right to nominate. Users shall have the right to nominate any other individual, who shall, in the event of death or incapacity of such User, exercise the rights provided above.

Who can use Our Services?

Our Services can be used by adults and minors subject to the legal consent of their parent or legal guardian. If you have achieved the age of majority and intend to avail the Services, or if you are the legal guardian of a minor intending to avail the Services, i.e., any person below 18 (eighteen) years of age, you hereby agree and acknowledge that you have provided your informed and unconditional consent on behalf of yourself or on behalf of the minor (as applicable), in accordance with applicable laws.
